Unless otherwise expressly defined, the following terms shall have the following meanings:
If the User does not agree to the terms contained hereunder, please do not further use or access the Platform or Services.
“User Information” means and includes the personal information of the User, any data relating to identified or identifiable living person (‘data subject’ herein referred to as the ‘User’) including but not limited to, name, date of birth, address, mailing address, telephone number, email ID, bank account details including details linked to credit / debit payment instruments, information about your mobile phone, identity proof such as Aadhaar card, PAN card, video KYC, financial details, scanned copies of various documents and any other details / documents relevant for availing the Services or any personal details that may have been voluntarily provided by the User directly or indirectly. The User Information includes, without limitation, the User’s preferences relating to receiving marketing messages from the Company and the Company’s service providers, and User’s communication preferences. The Company may also collect additional information on the basis of the Services rendered by the Company.
It is important that the User reads this Privacy Policy carefully because the User Information and data may be processed by the Company whenever the User uses the Platform App.
To improve its Services for the Users, the Company may collect (a) User Information, and (b) information related to the usage of the Platform the User (“Usage Information”). The User Information or the Usage Information may be collected to:
help the User in connecting with the relevant persons such as real estate promoters or agents or any Third Party for their requirements and queries.
The User Information or the Usage Information may be related to the following:
location information, if any, provided by the User while creating and registering the User Account, may be stored and associated with the User’s Account.
The Platform utilizes ‘cookies’ and other tracking technologies. A ‘cookie’ is a small text file that may be used to collect data about the User’s activity on the PlatformApp. Some cookies and other technologies may serve to recall User Information and Usage Information. Most browsers allow the User to control ‘cookies’, including whether or not to accept them and how to remove them.
The Company uses ‘session cookies’ to (a) keep the User logged-in while the User uses the Platform or avails the Services, (b) better understand how the User interacts with the Platform and the Services, and (c) monitor aggregate usage and web traffic information on the Platform App.
Tracking technologies may record information such as internet domain and host names, internet protocol (IP) addresses, browser software and operating system types, clickstream patterns and dates and times that the Platform is accessed.
The use of cookies and other tracking technologies allows the Company to improve the Platform and User experience on the PlatformApp. The Company may also analyse Usage Information that may or may not contain User Information for trends and statistics.
As the User uses, accesses and navigates through the PlatformApp, the Company may collect various types of User Information, which may or may not be personally identifiable information. This information is classified as:
Personal Information: which means personally identifiable information like the User’s name, address, age, email address and phone number; and
Sensitive Personal Information: which means the User’s financial information, passwords, any biometric, medical or health-related information; and
Other Information: which means all other information other than Personal Information or Sensitive Personal Information. For example, the nature of device, usage patterns and usage preferences, Platform access logs, local caches, location, IP address etc.
The Company may use the Personal Information to grant access to the PlatformApp, resolve User’s concerns / customer care, update the User for any changes or additions to our Services or our PlatformApp.
Any Other Information may be used by the Company for:
The Company’s business purposes;
Analytical purposes, data usage;
Improving the PlatformApp, or User’s experience; and
Providing targeted advertisements.
The Company will share any User Information with Third Party/ies, if, the Company in good faith believes that the same is required for the purposes of compliance with applicable laws, regulation, legal process or enforceable governmental request / action or any manner required for the purposes of protecting or safeguarding our rights, interests and properties.
The User shall agree and authorise the Company to disclose, from time to time, any information relating to the User (including personal or sensitive or other information or any other information that requires consent under applicable law), without the requirement of any notice or intimation:
to any of its affiliates and to any of its employees, agents, representatives etc.
to any credit information company, other agencies or any information utility or Third Party including but not limited to banks/financial institutions and other credit guarantors, as may be specified by the RBI or the Central Bank or Authority depending on the jurisdiction.
The Users shall agree and undertake to authorise the Company to carry out electronic KYC authentication (via e-KYC verification / liveliness check / video KYC verification) of the User and to fetch electronic KYC data from Unique Identification Authority of India (UIDAI) and/or from any other sources as permitted under the applicable laws.
The Users shall agree and undertake to authorise the Company to share and/or disclose the Personal Information, Sensitive Personal Information and Other Information of the User if the Company is involved in a merger, acquisition, joint venture, strategic transaction, reorganization, bankruptcy, insolvency, transition of Services to another entity (collectively referred to as “Transaction”) during the diligence process with counterparties and other parties assisting with the Transaction and transfer such data to the successor or affiliate as part of that Transaction along with other assets.
All payments in respect of the Services, either made to the User or received from the User shall be paid and processed through the designated channels / entity in the form of net banking / debit card / credit card / UPI and / or e - NACH. The designated channels / entity shall act only as a facilitator for the payments / transactions between the User and the Company and shall collect the payments due from the User on behalf of the Company.
From time to time, the Company makes the e-mail addresses of the User(s) available to other reputable organizations whose products or services the Company thinks might be interesting for the User(s). In case the User does not want us to share its e-mail address with other companies or organizations, the User may notify the same to us by emailing us at email ID mentioned under Clause 12 (Grievance Redressal Mechanism) hereunder.
The User who supplies the Company with its telephone numbers on-line may receive telephone or text message contact from us with information regarding the Services or upcoming events. In case the User does not wish to receive such telephone calls or text messages, the User may notify the same to the Company via email addressed to the email ID mentioned under Clause 12 (Grievance Redressal Mechanism) hereunder.
The User confirms that all the data and information furnished to the Company is true and correct.
The User expressly confirms and acknowledges that by using and accessing the Platform and availing the Services, the User has consented to the Company using their User Information and the Usage Information in the manner specified under this Privacy Policy.
The User’s consent may also have been obtained by the Company by way of an e-signature or a tick / check box on the PlatformApp.
Unless the User expressly revokes its consent, by writing to the Company via email mentioned under Clause 12 (Grievance Redressal Mechanism) hereunder, the consent once granted shall be deemed to be operative and the Company shall not be required to obtain any fresh / new consents from the User.
It is clarified that the consent granted by the User includes (but is not limited to) the consent for the following:
sharing the User Information with various credit agencies, financial institutions (NBFCs, AIFs, banks etc.) / credit bureau / credit information company such as the CIBIL for preparation of Financial Health Check Report (FHCR);
agreeing that the Company shall have unfettered rights to access the repository of a credit bureau or a credit information company such as CIBIL and/or any other agency so authorized by RBI or the Central Bank or Authority depending on the jurisdiction any number of times to ascertain/check the financial discipline and/or credit score of the User;
notifying the user in respect of changes to his/her credit scores;
agreeing and consenting that the Company shall, without any notice to the User, as it may deem appropriate and necessary, be entitled to use, all or any information and data (PAN, Address Proof, documents, etc.) relating to the User, for the purpose of availing the Services;
agreeing and consenting that the Company shall, as it may deem appropriate and necessary, disclose all or any information and data (PAN, Address Proof, documents, etc.) relating to the User, to a credit bureau or a credit information company (such as CIBIL) or to any other agency authorized under applicable law in this behalf;
agreeing that a credit bureau or a credit information company such as CIBIL and/or any other agency so authorized by RBI may use or/and process the aforesaid information and data disclosed by the Company as it deems fit and appropriate;
consenting and authorizing the Company to contact the User telephonically, through emails, calls, messages, SMS, WhatsApp, or other applications and also agrees to abide by the terms and conditions of such applications and agree to the risks associated with such applications or sharing of information through them;
collecting, using, or processing the User’s Personal Information, Sensitive Personal Information, in certain ways or sharing the Personal Information with any Third Party;
consenting and authorizing the Company, without any notice to the User, to share and disclose the aforementioned information to any credit bureau, financial institution, or any other authority for proper verification and other authentication services.
transferring the User Information outside of the country of User’s residence; or
using or placing ‘cookies’ on your computer or other electronic devices as per this Privacy Policy.
The User has the ability to control its User Information and Personal Information in accordance with applicable law.
The User shall have the ability to update its profile and related Personal Information/User Information at any time. Also, the User may review, update, correct, delete or object its Personal Information by writing to the Company via email at [•].
In case the User has concerns regarding the privacy, access or correction of the User Information or Personal Information, the User may contact the Company at the email ID mentioned under Clause 12 (Grievance Redressal Mechanism) hereunder.
Any request made by the User will be entertained by the Company only if the same contains the details of the User Information or Personal Information that the User would like to have changed.
All the issues raised by the User will be responded to by the Company within [•] days of receipt of the email from the User.
For Residents of United Kingdom and the European Economic Area
Company is considered the “data controller” of the “personal data” (as defined under the General Data Protection Regulation of European Union) handled under this Policy. The Company is responsible for deciding how to collect, use, and disclose personal data, subject to applicable law. The laws of the European Economic Area and the United Kingdom require data controllers to inform the User about the legal ground that they rely on for using, sharing, or disclosing the personal data of the User. To the extent these laws apply, the legal grounds are as follows:
Contractual Commitments: the Company may use, share, or disclose personal data to honour its contractual commitments to the User.
With User’s Consent: Where required by law, and in some other cases, the Company uses, shares, or discloses personal data on the basis of User’s consent.
Legitimate Interests: In many cases, the Company uses, shares, or discloses personal data on the ground that it furthers the Company’s legitimate business interests in ways that are not overridden by the interests or fundamental rights and freedoms of the affected individuals, such as customer service, certain promotional activities, analysing and improving the Company’s business, providing security for the Services, preventing fraud, and managing legal issues.
Legal Compliance: the Company needs to use and disclose personal data in certain ways to comply with legal obligations.
In addition to those rights described herein, the User has the right to lodge a complaint with the relevant supervisory authority. However, the Company requests the User to contact the Company first, and the Company will employs the means necessary to resolve the concern(s) of the User.
The Company will transfer the Personal Data of User to recipients outside of the EEA, Switzerland and the UK for the purposes described in this Privacy Policy. If the User is based in the EEA, Switzerland or the UK and the User’s Personal Data is transferred to a third country, that third country may not offer the same level of data protection as the User’s home country. However, the Company transfers Personal Data pursuant to applicable data protection laws. To transfer the User’s Personal Data outside of the EEA, Switzerland or the UK, the Company relies on the European Commission’s adequacy decisions on certain countries and, for other jurisdictions, the Company relies on the Standard Contractual Clauses as approved by the European Commission and any applicable country addenda. User’s account login credentials and payment card information
The Company may disclose this information to its affiliates, vendors and service providers, law enforcement, and parties involved in Transactions.
The Company shall endeavour, at all times, to implement reasonable security practices and procedures (such as managerial, operational, physical and technical) for the purpose of protection and safeguarding the User Information and the Personal Information. The Company is strongly committed to protecting the personal and financial information related to the User.
The Company shall endeavour to safeguard the security and confidentiality of User Information and Personal Information shared by the User with the Company. However, despite the utmost efforts of the Company to protect your Personal Information, the Company cannot warrant the security of any data that the User transmits through the PlatformApp. By accepting this Privacy Policy, the User accepts that such transmission of the Personal Information is done at the User’s own risk.
Lastly, the User is requested to help the Company in protecting the User’s Information and Personal Information by maintaining the secrecy of the username and password used by the User for accessing the Platform and availing Services of the Company.
The User’s Personal Information processed by the Company no longer than is necessary for the purposes for which it is processed, in line with the legal, regulatory, contractual or statutory obligations as applicable.
At the expiry of such periods, the User’s Personal Information shall be deleted or archived to comply with legal / contractual retention obligations or in accordance with applicable statutory limitation periods.
The services offered by the Company are global and the User’s information may be stored and processed in India and other countries outside the User’s country of residence that may have data protection laws that differ from the laws in the User’s country, and data may be accessible to law enforcement and national security authorities under certain circumstances. By using the Services, or providing us with any information, the User consents to the collection, processing, maintenance, and transfer of such information in and to India and other applicable countries in which the privacy laws may not be as comprehensive as, or equivalent to, those in the country where the User resides and/or is a citizen.
The Company reserves the right to change or update the Privacy Policy or any other policies / practices at any time without giving any prior notification to the User. The User is requested to review this Privacy Policy periodically. Any changes or updates will be effective immediately upon posting the same on our Ap Platform.p.
This Privacy Policy shall apply uniformly to the use and access of the Platform and Services (irrespective of the mode or media used by the User).
